Bail to Partha Gopal Banik: HC asks lower court judge to clarify reason in 7 days

The High Court has directed the lower court to reply within seven days as to why it granted ad-interim bail to suspended DIG prisons of Sylhet Partha Gopal Banik in a graft case.

A division bench comprising Justice M Enayetur Rahim and Justice Md Mostafizur Rahman passed the order on Monday following Anti-Corruption Commission (ACC) petition challenging the bail.

The ACC also referred to a report aired by Channel 24 TV raising question about transparency in the process of bail to the GIG. 

Judge Md Iqbal Hossain of the Special Court-5 of Dhaka will have to submit a written explanation within seven working days stating the basis for granting bail to Partha.

The HC also directed Channel-24 to submit video clipping and text of the report within the same time.

Appearing before the HC, Anti-Corruption Commission (ACC) counsel Khurshid Alam Khan said the lower court judge granted bail to Partha Gopal in an “unusual manner.”

On June 17, the lower court judge granted bail to suspended DIG (Prisons) despite specific allegations found against him, he said. The bail was granted ignoring serious opposition made the prosecution side, he added.

Earlier, two separate benches of the HC asked the lower court judge to finish trial of DIG Partha Gopal within six months and one year respectively. The judge granted bail based on the petition which concealed this formation, he said.

The judge granted him bail till July 15 upon a bond of Tk 50,000 with two guarantors and Partha got released following the bail. 

On July 28, 2019, Anti-Corruption Commission raided house of Partha in Dhaka and recovered Tk 80 lakh allegedly earned by him through illegal means. The following day, ACC sued him.

The ACC submitted charge-sheet to the court on August 24 last year while the lower court indicted Partha in the case on November 4.
